YASHIK FINLEASE PRIVATE LIMITED, a company incorporated under the Companies Act, 1956, having its registered office at 4th floor , Enkay Centre wing -A, Udyog Vihar Phase -V , Gurgaon Haryana- 122016 (hereinafter referred to as the “Company”, “YASHIK”, “we”, or “us”), is a duly registered Non-Banking Financial Company (NBFC) with the Reserve Bank of India (“RBI”). The Company operates and manages its official website yashikfin.com (the “Website”) as well as one or more mobile applications (collectively, the “Platform”).

By accessing, browsing, or in any manner using the Platform, the User (hereinafter referred to as “User”, “You”, or “Your”) expressly acknowledges, declares, and agrees to be legally bound by these Terms & Conditions (“Terms”). These Terms, together with our Privacy Policy, govern and regulate the use of the Platform and all the services, facilities, information, and products offered thereunder. If you do not agree with any of these Terms, you are advised to immediately discontinue the use of the Platform.

1. GENERAL

The Platform is designed and intended to serve as a comprehensive digital interface which facilitates communication, interaction, and transactions between various stakeholders, including but not limited to consumers, lenders, financial institutions, service providers, data partners, and other authorized third parties. The principal objective of the Platform is to enable and streamline lending and borrowing activities and to provide users with access to multiple financial products and value-added services.

The Company hereby explicitly clarifies that it does not, under any circumstances, function as a deposit-taking institution, chit fund, or an entity providing investment schemes as defined under any prevailing legislation or regulations currently applicable in India. All decisions concerning the sanction, disbursement, or rejection of loan applications or the provision of any other financial product are taken at the absolute discretion of the Company, and no representation to the contrary shall be construed.

2. SERVICES PROVIDED

The Company undertakes to provide a broad range of services (“Services”) through the Platform, which may include, without limitation, the following:

Facilitating the purchase, use, and management of products and services made available on the Platform
Accessing, monitoring, and updating Users’ credit reports as obtained from authorized credit information companies.
Providing support to Users in verifying their financial history and repayment capability.
Conducting backend financial analytics, including analysis of income and expenses through integration with authorized third-party service providers. Such analysis is conducted internally and is not disclosed directly to the User.

By registering on and using the Platform, You provide Your free, informed, and unequivocal consent to the Company to collect, use, store, transfer, disclose, and otherwise process Your information with banks, NBFCs, financial institutions, credit agencies, and other authorized third parties, as may be required for the purpose of enabling the Services. You further consent to the Company conducting multiple credit checks and inquiries in order to obtain the most appropriate and suitable financial offers to meet Your requirements. All such data collection and processing shall be in strict compliance with the Company’s Privacy Policy.

3. ELIGIBILITY

By using the Platform, You hereby affirm, represent, and warrant that:

You possess the full capacity, legal rights, and authority to enter into and abide by these Terms.
All information provided by You is true, accurate, current, and complete in all respects.

If at any stage the Company has reason to believe, or is notified, that the information furnished by You is inaccurate, false, misleading, incomplete, or otherwise not in compliance with these Terms, the Company reserves the unfettered right, without liability, to suspend, restrict, or terminate Your account and/or deny access to the Platform with immediate effect.

4. ACCEPTANCE OF TERMS

Your access to and use of the Platform constitutes Your unconditional acceptance of these Terms, as well as any other policies, disclaimers, rules, or notices that may be published or communicated by the Company from time to time. The Company retains the absolute right, at its sole discretion, to add, amend, modify, suspend, or delete any part of these Terms without providing prior notice to the User. It is Your responsibility to regularly review these Terms to stay informed of any updates or changes. Continued use of the Platform following modifications shall amount to Your acceptance of the revised Terms.

5. USER ACCOUNT & RESPONSIBILITIES

In order to access certain Services, You may be required to create and maintain an account on the Platform by providing such information as the Company may require. You shall be solely responsible for ensuring the confidentiality, security, and proper use of Your login credentials. You shall accept responsibility for all activities conducted under Your account and agree to notify the Company immediately in the event of unauthorized access or suspected compromise of Your account credentials.

The Company reserves the right to suspend or terminate Your account if it has reason to believe that the information provided is false, misleading, inaccurate, or incomplete, or that the account is being misused or used for unlawful purposes.

The right to access and use the Platform is personal to You and shall not be assigned, licensed, or transferred to any other person or entity without the express written consent of the Company.

6. PAYMENTS & AUTHORIZATIONS

You hereby irrevocably authorize the Company to receive payments, charges, and fees due in respect of loans or services availed through electronic mandates, including but not limited to ECS, e-NACH, or e-Mandates, or by any other legally permissible payment mechanism. You shall ensure the availability of sufficient funds in Your designated account on the due dates to enable timely processing of repayment instructions.

In the event of delay, dishonor, or failure of payment due to insufficient funds, incorrect details, bank refusal, or circumstances beyond the control of the Company, You shall remain fully liable for any penalties, charges, or consequences arising therefrom. The Company shall not be held liable for any failure in processing payments except in cases where such failure is directly and solely attributable to its gross negligence or willful misconduct.

7. PRIVACY

The Company places the utmost importance on the privacy and confidentiality of User data. All information collected from You shall be utilized strictly for the purposes of providing Services and shall be handled in accordance with the Privacy Policy of the Company. By using the Platform, You consent to the collection, use, processing, storage, and disclosure of Your information in the manner described in the Privacy Policy. The Privacy Policy is incorporated herein by reference and forms an integral part of these Terms.

8. LICENSE AND ACCESS

Subject to Your full compliance with these Terms, the Company grants You a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform solely for the purposes of availing the Services. This license does not include any rights to commercially exploit the Platform, copy or reproduce any content for commercial use, or use data mining, robots, or similar data gathering tools. Any unauthorized use or attempted misuse of the Platform shall result in immediate termination of the license granted herein.

9. MONITORING AND SUSPENSION

The Company retains the right, but not the obligation, to monitor all activities conducted on the Platform, including the content of User accounts. Monitoring may be conducted to verify accuracy, ensure compliance with these Terms, and to detect fraudulent or unlawful conduct. The Company further reserves the right to remove any content deemed objectionable or in contravention of applicable laws or these Terms, and to suspend or terminate Services at any time, without prior notice and without liability.

10. PROHIBITED USES

You undertake not to use the Platform for any unlawful, fraudulent, or harmful purpose, including but not limited to:

Violating any applicable law, regulation, or guideline.
Uploading, transmitting, or disseminating viruses, malware, or other harmful software code.
Harassing, abusing, defaming, threatening, or discriminating against other Users or any third party.
Infringing upon intellectual property or proprietary rights of the Company or others.
Attempting unauthorized access to any systems or accounts connected to the Platform.

Violation of this clause shall result in immediate suspension or termination of Your account and may further attract civil and criminal liability under applicable law.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the Company, its affiliates, directors, officers, employees, agents, and partners shall not be liable for any indirect, incidental, consequential, exemplary, or punitive damages, including but not limited to loss of profits, goodwill, data, or business opportunities, arising out of or related to Your use of the Platform or the Services. The Platform and Services are provided strictly on an “AS IS” and “AS AVAILABLE” basis. The Company expressly disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

The maximum aggregate liability of the Company, whether in contract, tort, or otherwise, shall not exceed the actual amount paid by You to the Company for the specific Service giving rise to such liability.

12. INDEMNITY

You hereby agree to indemnify, defend, and hold harmless the Company, its affiliates, employees, officers, directors, agents, and representatives from and against any and all claims, demands, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

Your breach or violation of these Terms.
Your misuse of the Platform or Services.
Any infringement or violation of third-party rights by You.
Any fraudulent, negligent, or unlawful act committed by You.

This indemnity shall survive termination or expiry of these Terms and Your use of the Platform.

13. THIRD-PARTY LINKS AND ADVERTISEMENTS

The Platform may display or provide links to external websites, services, or advertisements. Such links are provided solely for Your convenience and informational purposes. The Company does not endorse, guarantee, or assume any responsibility for the accuracy, reliability, or legality of third-party content. Accessing any third-party website or service shall be entirely at Your own risk.

14. USER FEEDBACK AND SUBMISSIONS

Any comments, suggestions, feedback, proposals, or other submissions voluntarily provided by You to the Company shall become the sole property of the Company. By submitting such material, You grant the Company a perpetual, worldwide, royalty-free license to use, reproduce, publish, modify, adapt, and distribute the same in any medium. The Company shall have no obligation to maintain confidentiality or provide compensation in respect of such submissions.

15. ACKNOWLEDGEMENTS BY USER

You acknowledge, understand, and agree that:

The Company does not guarantee the accuracy, authenticity, or completeness of information provided by other Users.
The Company shall not be liable for any misrepresentation, fraud, cheating, or unlawful conduct committed by any User on the Platform.
It is solely Your responsibility to verify the authenticity of any information, offers, or transactions conducted on the Platform before acting upon the same.

16. GOVERNING LAW AND JURISDICTION

These Terms and any dispute, claim, or controversy arising out of or in connection with the Platform or Services shall be governed by and construed in accordance with the laws of India. The courts located at Haryana, India, shall have exclusive jurisdiction over all disputes arising hereunder, subject always to applicable laws.

The Company undertakes to address and resolve genuine grievances in a fair, transparent, and timely manner in accordance with applicable regulatory requirements.
